Me and my girls are planning to sleep the car... Is there others who will be joining us in the parking lot? :)

I'll join you, I'm a huge drunk who passes out in my car all the time. I'm not sure how much sleep we'll get though.

good chance you will be towed if you try and do this, it is against the rules. it's also illegal in the state of california to sleep in a car on a public street. best bet is to drive to a truck stop and sleep there in the car.

Not too smart..... I think ppl are trying to avoid DUI's. Who cares if its against the rules, at least ppl are trying to be responsible.

However, I don't think the event will allow them to do this. They might make them leave if they see that they're sleeping in the parking lot and not on the grounds. Just my thought.

There will be plenty of parking adjacent to the festival grounds. Parking is free. There is no overnight parking allowed unless you are onsite camping.."
says this on the coachella website, guessing it is the same for stagecoach:
"Please note that festival "DAY PARKING" is not for overnight parking or campers and cars will be towed at 3am."

A few years ago our PBR friend Frank tried to sleep in his truck since we kicked him out of our camp-site. Security made him leave his truck.

in the state of CA you can get a DUI even if you are asleep in the back seat. as long as you are in the car drunk they say you have the intention to drive and you will receive a DUI....

ya i know the rule sounds stupid but i wouldnt want to be arrested or ticketed for a dui when im trying to be responsible and not drive.... but thats California for you.......

I'm pretty sure the keys have to be in the ignition in order to get a DUI. Actually I'm darn near positive on that one, anyone wanna look it up?

That's my personal experience. Keys in the ignition. No, I have never had a DUI. I see this kind of thing at work though.

i could be wrong, but thats what they've told us in traffic school. i never got a dui either but have had a ticket or two :(

What DUI Sleeping Actually Means
DUI sleeping is the term that has been developed to address different ways that people may be in a motor vehicle behind the wheel drunk but not actually driving. DUI sleeping means that you can be in your car, be drunk and be asleep behind the wheel and still get a ticket, even if your vehicle is not running. One condition of DUI sleeping is that your keys are in the ignition. DUI sleeping can be the result of simply being in the wrong place at the wrong time but it is still your responsibility to ensure that you are not in a motor vehicle operational position while you are under the influence of alcohol.
How You Can Avoid DUI While Sleeping
If you have been drinking, you should not drive, it’s that simple. Sometimes, people who have only had a drink or too can drive safely and get to their destination without a problem. When you have had enough drinks to be DUI, you are putting yourself and others at risk. The best way to avoid DUI while sleeping is:
* When you know you’re going to be drinking heavily, designate a driver and give your keys to them at the beginning of the night.
* Leave your vehicle at home and take a cab to and from your destination.
* Take public transportation where available.
* Don’t get behind the wheel of any vehicle.
* If you are out of town, plan to get a hotel room at a nearby hotel and walk or take a shuttle back to your room.
DUI while sleeping is considered a serious offense just as other driving under the influence infractions are. If you are determined to be DUI while sleeping, you are subject to the same penalties as any other infraction that involves alcohol and driving. This means you will most likely have to go to some sort of alcohol education program when the judge finds you guilty. There may be some exceptions, such as having someone place you behind the wheel and you fall asleep there but this will place the burden of proof on your when you appear before the judge. In such a case, it is best to have an attorney to represent you so that you are able to benefit from their expertise.

Ok good, that's what I thought it was. I've actually seen drunk people just sitting in their cars before and knocked on the window and told them to take the keys out of the ignition, even if their not driving anywhere.

In high school we were up on Mt. Soledad on a Friday night and one of our friends locked his keys in the car. Cops come around and see him trying to get in, his ID shows that vehicle registered to him so they bring out a jimmy to help him open the door. He shows they paperwork inside and it matches and it's all good. We're laughing, cops are amused, he's chagrined. Funny.....
Car parked next to us had two other teens sitting inside it with the key in the ignition, radio on, drinking beer. Cops see this, because they're too stupid to take the beers out of their laps, and the driver was arrested for underage drinking and DUI because the keys were in the ignition.

It might not be the best idea to sleep in your car. A DUI is going to cost WAYYY more then a camping spot of a taxi to a hotel room, not to mention the fee and classes you are going to have to take along with it! I have a friend who got a DUI just because he was drunk and sitting in his back seat. Keys were in the glove box but he could still get them and drive if he wanted to so they arrested him. Not a good situation to be in.
Just a thought.

Easy solution - Sleep in the passenger seat!!! Then you aren't in a driving position! :0)

Ha ha... It doesnt matter where in the car you are sitting. As long as you are drunk and in the car with your keys where you can get them and drive, you can get a DUI.

How about just try and find someone to camp with? This would avoid all kinds of 'not so good' stuff.

I think your friend had to have done something else to get that, because the keys DO have to be in the ignition. Think about it, if you have a designated sober driver and you are drunk in the back or passenger seat, are you saying you'd still get a DUI if the sober friend was pulled over? Because the same rule would apply in that case. Maybe your friend was sitting in the back seat but was listening to music? Open container? Something else had to be a factor for that to be upheld.

no he was not drive... Him and his gf drank a little too much at party or somewhere like that and they didnt want to drive home so they put the keys in the glove box and slept in the back seat. Yea they were first stopped because they were sleeping in a car on the street which is not allowed in Ca, but thats when they got the DUI. They were woken up by a cop tapping on the window and they both got arrested. Im not sure if she got a DUI but i know he did for sure.
Its different if their is a sober driver, or somebody that can drive you home, but if everybody in the car has been drinking and is over the limit (which i think they all would be if they are staying the the parking lot instead of driving somewhere), then one or more can get a DUI.

My brother, who is a narc cop in San bern, told me that as long as you are not in the driver seat, and the keys are...say in the glove box, then you have NO intent to drive. So he said stay out of the driver seat and hide your keys.

So, say you pull over on a side of a road, park in front of a home to sleep it off. Do you know those people that own that home, can they verify you got drunk there?
But if you drink at a bar, then drive down the street, then decide to pull over, that is a DUI.
You can get an arse of a cop if you never moved your vehicle, like staying parked outside a bar that you did get drunk at...but it will probably never go to court/trial since it is not a moving violation, it would have to be proven you drove and that consitutes a moving violation...a DUI "DRIVING under the influence"

Precisely. Which is why you never admit to having even one beer if you get pulled over. 1 beer = field sobriety test automatically. If you deny it, and seem ok, they normally won't test you. I learned that one night I really did have only one beer and admitted it. Out of my car, following a light with my eyes. Right outside my house actually which sucked. I passed, no problem, but now know better than to say I had one drink.

Yeah I'm pretty sure its different if you are in a parking lot or on a street. But again if you try to drive which you shouldn't and you do decide to pull over and go to sleep then take the keys out of the ignition and then sleep in a seat other than the drivers seat. Also when the cops knock on the window deny drinking and tell them u were just too tired and decided to sleep.

My major is Criminal Justice and in order to get a DUI in a parked car the keys have to be in the ignition.

But also, in the drivers seat can get you one, even with the keys in the glove box. It is "intent to drive".
